Terms of Service

1. Acceptance

By creating an account or using CaloPair ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

CaloPair is a calorie-tracking and accountability app that pairs two users. The app uses artificial intelligence (AI) to estimate calories from food photos and to provide progress insights and coaching suggestions. All AI-generated content — including calorie estimates, progress analysis, and coaching suggestions — are approximations and may be inaccurate, incomplete, or nonsensical. They should never be relied upon for medical, nutritional, or health decisions.

3. Not Medical Advice

THE SERVICE IS NOT A MEDICAL DEVICE, MEDICAL SERVICE, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. CaloPair does not provide medical advice of any kind. Always consult a qualified healthcare provider before beginning, modifying, or ending any diet, exercise program, or weight management plan. If you experience any adverse health effects, stop using the Service immediately and seek medical attention.

4. Eligibility

You must be at least 18 years old. The Service is not intended for individuals with eating disorders, a history of disordered eating, or any medical condition that requires supervised dietary management. If any of these apply to you, do not use this app without explicit approval from your healthcare provider.

5. Assumption of Risk

You acknowledge that calorie tracking, weight management, and dietary changes carry inherent health risks including but not limited to: malnutrition, electrolyte imbalances, metabolic disorders, unhealthy relationships with food, and in extreme cases, serious injury or death. By using the Service, you voluntarily assume all such risks. You are solely responsible for determining whether the calorie targets, food choices, and weight goals you pursue are safe and appropriate for your individual health circumstances.

6. AI-Generated Content

• The Service uses third-party AI models to estimate food calories from photos, analyze weight trends, and generate coaching suggestions.
• AI outputs may be wrong, misleading, or nonsensical. They are generated by machine learning models, not by medical or nutrition professionals.
• You must exercise your own judgment before acting on any AI-generated suggestion. We are not responsible for any action you take based on AI output.
• AI models may occasionally produce inappropriate, irrelevant, or contradictory content. Report any concerns to support.

7. Account & Subscription

• Free trial: 14 days (or longer with valid promo code).
• After trial: $4.99/month per pair (both users covered).
• You may cancel anytime. Access continues through the paid period.
• Refunds are at our sole discretion.

8. Acceptable Use

• Do not upload inappropriate, illegal, or offensive images.
• Photo uploads are limited to 30 per day per user.
• Do not attempt to reverse-engineer, abuse, or overload the Service.
• Do not create accounts for bots or automated use.

9. Privacy & Data

We store your email, alias, food logs, calorie data, and weight logs. Photos sent for calorie estimation are processed by a third-party AI provider and not permanently stored on our servers after processing. AI progress insights are generated from your aggregated, non-identifying health data (calorie totals, weight trends) — no personally identifiable information (name, email, address) is sent to AI providers. 10. Disclaimers

• NO MEDICAL ADVICE. CaloPair is an informational tool only. It is not a substitute for professional medical advice.
• AI ACCURACY. AI calorie estimates and coaching insights may be inaccurate, incomplete, or entirely wrong. We make no representations about their accuracy.
• NO WARRANTY. The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• HEALTH OUTCOMES. We are not responsible for any health outcome — positive or negative — that results from your use of this Service or reliance on its outputs.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCRIPTURA SOFTWARE, ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: PERSONAL INJURY, ILLNESS, DEATH, WEIGHT-RELATED HEALTH COMPLICATIONS, EATING DISORDERS, METABOLIC DAMAGE, EMOTIONAL DISTRESS, DATA LOSS, OR SERVICE INTERRUPTIONS — REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Scriptura Software and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your reliance on AI-generated content; (c) any health outcome related to dietary or exercise decisions you make while using the Service; or (d) your violation of these Terms.

13. Referral Program

Users may share referral codes. Both the referrer and the new user receive 30 bonus trial days. Abuse of the referral system (fake accounts, self-referral) will result in account termination.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account by contacting support.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

16. Changes

We may update these Terms at any time. Continued use after changes constitutes acceptance.
